These Terms and Conditions govern your use of StoryStar Club. Please read them carefully. By using our services, you agree to be bound by these terms.

1. ABOUT THESE TERMS

1.1 Contracting entity

These Terms and Conditions, referred to as the "Terms", govern access to and use of StoryStar.

StoryStar is operated by:

In these Terms, "StoryStar", "we", "us" and "our" refer to The Be. Concept Group FZCO.

1.3 Acceptance

By creating an Account, starting a free trial, purchasing a subscription or Digital Product, submitting content, accepting a narration invitation, or otherwise accessing or using the Services, you confirm that:

  • you have read and understood these Terms;
  • you agree to be legally bound by these Terms;
  • you agree to the StoryStar Privacy Policy and any additional terms shown during checkout; and
  • you have the legal capacity and authority to enter into this agreement.

1.4 Mandatory rights

Nothing in these Terms excludes, restricts or overrides any consumer, privacy or other legal right that cannot lawfully be excluded or limited.

2. DEFINITIONS

In these Terms:

  • 2.1 Account: "Account" means a registered StoryStar customer, contributor or administrator account.
  • 2.2 Account Owner: "Account Owner" means the adult who creates and controls the primary family Account.
  • 2.3 Child Profile: "Child Profile" means a profile created by an Account Owner for a child.
  • 2.4 Content: "Content" includes stories, text, illustrations, images, photographs, recordings, narration, audio, video, Story Journeys, Learning Adventures, Shared Adventures, Memory Adventures, digital keepsakes and other materials available through StoryStar.
  • 2.5 Digital Products: "Digital Products" means subscriptions, Story Credits, Download Credits, personalised stories, custom stories, downloadable products, audio products, video keepsakes, premium features and other electronically supplied products or services.
  • 2.6 Download Credits: "Download Credits" means digital entitlements that may be redeemed for eligible downloadable StoryStar products.
  • 2.7 Family Narration: "Family Narration" means an authentic voice recording made or submitted by an authorised family member or contributor and linked to a particular story.
  • 2.8 Family Member: "Family Member" means a parent, guardian, grandparent, sibling, cousin, relative, family friend or other authorised contributor connected to a family Account. References to Family Members may also include pets where relevant to story personalisation.
  • 2.9 Founding Family: "Founding Family" means an Account expressly approved by StoryStar for participation in the StoryStar Founding Family programme.
  • 2.10 Learning Adventures: "Learning Adventures" means educational or developmental stories offered through StoryStar.
  • 2.11 Memory Adventure: "Memory Adventure" means a personalised story based wholly or partly on family information, experiences, events, photographs or memories submitted by a User.
  • 2.12 Personal Data: "Personal Data" has the meaning assigned to it under applicable data protection law.
  • 2.13 Platform: "Platform" means StoryStar's websites, web applications, software, administrative systems and related online services.
  • 2.14 Printed Products: "Printed Products" means printed storybooks, yearbooks, keepsake books, gift editions and any other physical products offered through StoryStar.
  • 2.15 Services: "Services" means the Platform, Content, subscriptions, features and products provided by StoryStar.
  • 2.16 Shared Adventure: "Shared Adventure" means a story in which multiple children, relatives, friends or other approved participants appear together.
  • 2.17 Story Credits: "Story Credits" means digital entitlements that may be redeemed for eligible story-creation or customisation functionality.
  • 2.18 Story Journey: "Story Journey" means a connected series of stories, episodes or chapters.
  • 2.19 User: "User", "you" and "your" mean any person accessing or using StoryStar.
  • 2.20 User Content: "User Content" means photographs, recordings, names, memories, preferences, child and family information, feedback and other content submitted by or on behalf of a User.

3. ELIGIBILITY AND CHILDREN'S USE

3.1 Adult Account holders

You must be at least eighteen years old and legally capable of entering into a binding contract to create an Account, start a trial or purchase a StoryStar product.

3.2 Child access

StoryStar is intended for family use under the supervision of an adult.

A child may not independently:

  • create a paid Account;
  • agree to these Terms;
  • submit payment information;
  • purchase Digital Products;
  • create or distribute narration invitations; or
  • provide Personal Data without appropriate adult involvement.

3.3 Parental or guardian authority

By creating a Child Profile, you represent and warrant that you:

  • are the child's parent or legal guardian; or
  • have lawful authority and all necessary permissions to provide and manage the relevant information.

3.4 Responsibility for child access

The Account Owner is responsible for:

  • supervising a child's use of StoryStar;
  • reviewing personalised or AI-assisted Content before making it available to a child;
  • managing Child Profiles and access permissions; and
  • deciding whether Content is appropriate for the child.

4. ACCOUNT REGISTRATION AND SECURITY

4.1 Accurate information

You must provide complete, accurate and current information when registering and must update that information when necessary.

4.2 Account security

You are responsible for:

  • keeping Account credentials confidential;
  • maintaining the security of devices used to access StoryStar;
  • restricting unauthorised access to your Account; and
  • promptly notifying StoryStar of suspected unauthorised access.

4.3 Account activity

You are responsible for activity conducted through your Account, except to the extent that such activity results directly from StoryStar's failure to apply reasonable security measures.

4.4 Verification

StoryStar may request reasonable information to verify:

  • identity;
  • age;
  • parental or guardian authority;
  • ownership of an Account;
  • consent to use a photograph or recording; or
  • entitlement to request access, correction or deletion.

4.5 Unauthorised accounts

StoryStar may suspend or close an Account that is false, fraudulent, misleading, unauthorised or created in breach of these Terms.

5. CHILD AND FAMILY PROFILES

5.1 Profile information

Child and Family Member Profiles may include:

  • first name or nickname;
  • age or age range;
  • interests and preferences;
  • relationship information;
  • photographs;
  • story preferences;
  • reading or developmental preferences;
  • language preferences; and
  • other information required for personalisation.

5.2 Data minimisation

Users should provide only the information reasonably necessary to use StoryStar.

Users should not submit unnecessary sensitive information, official identity documents, precise home addresses, school addresses or other information not requested by StoryStar.

5.3 Permission to submit information

You must have appropriate authority or permission to submit Personal Data, photographs, recordings or memories concerning another person.

5.4 Accuracy

You are responsible for checking the accuracy of names, relationships, photographs and other details before generating or ordering personalised Content.

5.5 Pets

Pet information may be used for story personalisation but should not include information that unnecessarily identifies a family's precise location.

6. STORYSTAR SERVICES

6.1 Available Services

StoryStar may provide:

  • personalised library stories;
  • custom stories;
  • Shared Adventures;
  • Learning Adventures;
  • Memory Adventures;
  • Monthly Story Packs;
  • Story Journeys;
  • Family Narration;
  • audiobook or standard narration;
  • digital downloads;
  • video or audio keepsakes;
  • Printed Products; and
  • other family storytelling services.

6.2 Service availability

Features may vary according to:

  • subscription plan;
  • country;
  • language;
  • child age or profile settings;
  • device;
  • trial or Founder status;
  • product-release stage; and
  • technical or legal availability.

6.3 Content changes

StoryStar may add, update, replace or remove stories, illustrations, narrators, story worlds, features and third-party integrations.

6.4 No guarantee of permanent availability

Unless expressly stated otherwise, subscribing does not guarantee that any particular story, feature, illustration style, narration option or third-party integration will remain available permanently.

7. PERSONALISED AND AI-ASSISTED CONTENT

7.1 Use of artificial intelligence

StoryStar may use artificial intelligence and automated technology to:

  • personalise stories;
  • generate or adapt custom Content;
  • create illustrations;
  • translate Content;
  • recommend stories;
  • support Content moderation; and
  • improve the operation of the Services.

7.2 Nature of generated Content

You acknowledge that AI-assisted Content may occasionally:

  • contain inaccuracies;
  • include unexpected wording;
  • be incomplete or inconsistent;
  • fail to reflect a request precisely; or
  • require review by an adult.

7.3 Parental review

The Account Owner should review personalised and generated Content before presenting it to a child.

7.4 No professional advice

StoryStar Content is provided for family storytelling, entertainment and general educational enjoyment.

It is not:

  • medical advice;
  • psychological or therapeutic advice;
  • legal advice;
  • financial advice;
  • a formal educational assessment;
  • an accredited curriculum; or
  • a substitute for a qualified professional.

7.5 Learning Adventures

Learning Adventures are intended to encourage curiosity, conversation and enjoyment. StoryStar does not guarantee a particular academic, developmental or educational outcome.

7.6 Content concerns

Users may report inappropriate, inaccurate or unsuitable Content to support@storystar.club.

StoryStar may review, regenerate, modify or remove reported Content where reasonably appropriate.

8. FAMILY NARRATION

8.1 Authentic story-specific narration

Family Narration allows an authorised person to record a particular StoryStar story in their own voice.

A narration may be linked to:

  • a specific story;
  • a particular version of a story;
  • a child or family Account;
  • the narrator's identity or contributor profile; and
  • the narrator's stated family relationship.

8.3 Invitations

The Account Owner may invite an approved Family Member or contributor to narrate a story.

The invitation may provide limited access only to:

  • the selected story;
  • the recording interface; and
  • related playback or review functionality.

8.4 Account Owner responsibilities

The Account Owner must:

  • invite only people known to the family;
  • provide an accurate email or contact address;
  • explain the intended family use where necessary;
  • revoke invitations that should no longer be active; and
  • respect a narrator's request to stop using or delete their recording.

8.5 Permitted use

Family Narration may be used only for private, personal and non-commercial family storytelling purposes.

8.6 Prohibited use

You must not use Family Narration to:

  • impersonate another person;
  • mislead or deceive;
  • commit fraud;
  • harass or threaten;
  • create unlawful or harmful material;
  • falsely suggest endorsement; or
  • commercially exploit a person's voice without appropriate permission.

8.7 No voice cloning

Unless StoryStar introduces a separate feature with separate and explicit informed consent, authentic Family Narration recordings will not be used to create an AI voice clone.

StoryStar will not use Family Narration recordings to train a voice-generation model without a separate lawful basis and explicit consent where required.

8.8 Recording quality

The quality of Family Narration may depend on:

  • the narrator's device and microphone;
  • internet connection;
  • background noise;
  • browser compatibility; and
  • the recording environment.

8.9 Replacement and deletion

An authorised User may replace or delete a narration, subject to Account permissions and applicable retention requirements.

A narrator may contact privacy@storystar.club to request the removal of their recording.

8.10 Existing generated stories

Deleting a Family Narration may remove future playback of that recording. StoryStar is not required to recreate a deleted recording.

9. USER CONTENT

9.1 User ownership

As between you and StoryStar, you retain ownership of the User Content you submit, subject to any rights belonging to another person.

9.2 Licence to provide the Services

You grant StoryStar a non-exclusive, worldwide, royalty-free, limited licence to host, store, copy, process, resize, adapt, format, transmit and display User Content solely as reasonably necessary to:

  • provide the Services;
  • personalise Content;
  • fulfil an order;
  • maintain security;
  • comply with law; and
  • exercise StoryStar's rights under these Terms.

9.3 No sale of User Content

StoryStar will not sell a family's photographs, voice recordings or child-profile information as standalone data.

Further information about data handling appears in the StoryStar Privacy Policy.

9.4 User warranties

You represent and warrant that:

  • you own or have permission to submit User Content;
  • StoryStar's permitted use will not infringe another person's rights;
  • the User Content is not unlawful, harmful or misleading; and
  • all required consents have been obtained.

9.5 Removal

StoryStar may remove, restrict or refuse User Content that:

  • breaches these Terms;
  • creates a child-safety or privacy concern;
  • infringes third-party rights;
  • creates legal or security risk; or
  • is technically incompatible with the Platform.

9.6 Feedback

If you submit ideas, suggestions or feedback, you grant StoryStar permission to use them to improve the Services without payment or obligation to you.

StoryStar will not publicly identify you as the source of feedback without permission.

10. STORYSTAR INTELLECTUAL PROPERTY

10.1 StoryStar ownership

StoryStar and its licensors retain all rights in:

  • the Platform and software;
  • StoryStar branding and trademarks;
  • the Family Constellation identity;
  • interfaces and designs;
  • original StoryStar library Content;
  • story frameworks and templates;
  • illustrations and visual assets;
  • databases and taxonomies;
  • recommendation and personalisation systems; and
  • all related intellectual property.

10.2 Personal-use licence

Subject to these Terms and payment of applicable fees, StoryStar grants you a limited, non-exclusive, non-transferable, revocable licence to access and use eligible Content for private, personal and non-commercial family purposes.

10.3 Restrictions

You must not, without written permission:

  • resell StoryStar Content;
  • publish it commercially;
  • make it publicly available;
  • reproduce it at scale;
  • create a competing story library from it;
  • remove copyright or ownership notices;
  • reverse engineer the Platform;
  • scrape or systematically extract Content;
  • use StoryStar Content to train another AI system; or
  • claim StoryStar intellectual property as your own.

10.4 Personalised output

Your access to a personalised story does not transfer ownership of StoryStar's underlying templates, story systems, artwork, technology or brand assets.

11. SUBSCRIPTION PLANS

11.1 Plan information

Available plans, billing frequencies, prices and entitlements are displayed on the StoryStar pricing or checkout pages.

Plans may include:

  • StoryStar Family;
  • StoryStar Family+;
  • Founding Family access;
  • promotional plans; and
  • future archive or legacy-access products.

11.2 Plan entitlements

Plan entitlements may include limits on:

  • Child Profiles;
  • custom Story Credits;
  • Download Credits;
  • Family Narrations;
  • Memory Adventures;
  • contributor access;
  • downloads;
  • storage;
  • Story Journeys; and
  • other premium functionality.

11.3 Commercially reasonable changes

StoryStar may change future plan pricing, Content, limits or features.

Where required by law or reasonably appropriate, StoryStar will provide notice before a material change affects an existing paid renewal.

11.4 Price changes

Unless otherwise stated, a price change applies from the next renewal occurring after the effective date communicated to the User.

A User may cancel before the affected renewal.

11.5 Taxes

Displayed prices may be exclusive or inclusive of applicable taxes, depending on the customer's location and checkout provider.

The taxes and total amount payable will be displayed during checkout.

12. FREE TRIALS

12.1 Trial offer

StoryStar may offer a free trial for the duration shown during registration, including a seven-day trial.

12.2 Payment method

A valid payment method may be required before a trial begins.

12.3 Trial disclosures

Before a User starts a trial, StoryStar will display:

  • the trial duration;
  • the selected plan;
  • the price payable after the trial;
  • the billing frequency;
  • the first billing date; and
  • instructions for cancellation.

12.4 Automatic conversion

Unless cancelled before the trial ends, the selected paid subscription will begin automatically and the applicable fee will be charged.

12.5 Trial cancellation

A trial may be cancelled through:

  • Account → Subscription & Billing → Cancel Subscription

12.6 Failure to use or cancel

Failure to use the Services or forgetting to cancel before the disclosed trial expiry does not, by itself, create an entitlement to a refund, subject to mandatory law.

12.7 Trial restrictions

StoryStar may restrict:

  • the number of free trials per person, household, payment method or device;
  • access to particular features; and
  • eligibility following previous trial use or suspected abuse.

13. BILLING AND AUTOMATIC RENEWAL

13.1 Advance billing

Subscription fees are charged in advance for the applicable monthly or annual term.

13.2 Automatic renewal

Subscriptions renew automatically for successive billing periods unless cancelled before the next renewal.

13.3 Payment authorisation

You authorise StoryStar and its authorised payment provider to charge the payment method selected at checkout for:

  • subscriptions;
  • renewals;
  • Digital Products;
  • Credits;
  • Printed Products;
  • shipping;
  • taxes; and
  • other approved purchases.

13.4 Merchant of Record and payment processors

StoryStar may use one or more authorised payment processors or Merchants of Record to:

  • process payments;
  • manage subscriptions;
  • provide invoices or receipts;
  • manage payment disputes;
  • perform fraud controls; and
  • calculate, collect and remit applicable taxes.

13.5 Direct web sales

StoryStar subscriptions are currently offered through the StoryStar website or authorised web checkout.

StoryStar is not currently offering subscriptions through mobile app stores.

13.6 Failed payments

If a payment fails, StoryStar or its payment provider may:

  • retry the payment;
  • request an updated payment method;
  • restrict paid features;
  • suspend the subscription; or
  • terminate paid access after reasonable notice.

13.7 Billing information

You are responsible for maintaining accurate billing information.

14. SUBSCRIPTION CANCELLATION

14.1 Right to cancel

You may cancel a StoryStar subscription at any time through:

  • Account → Subscription & Billing → Cancel Subscription

14.2 Transparent cancellation

StoryStar does not require Users to telephone, open a support ticket, send an email or use live chat solely to cancel a subscription.

14.3 Effect of cancellation

Cancellation stops the next automatic renewal.

Paid access continues through the end of the current paid billing period. After that date, stories and other paid features cannot be read, listened to, created, shared or downloaded unless the subscription is reactivated.

14.4 Monthly subscriptions

A monthly cancellation takes effect at the end of the current monthly term. No prorated refund is given for unused time, except where required by law or provided under Section 20.

14.5 Annual subscriptions

An annual cancellation prevents renewal at the end of the annual term. Access remains available until the paid term ends.

No prorated refund is given merely because a User no longer wants or uses the subscription.

14.6 Subscription cancellation and Account deletion

Cancelling a subscription schedules the Account and its stored family Content for deletion six calendar months after the paid access period ends, unless the subscription is reactivated before that deadline.

During this six-month retention period, the Account and stories are stored for reactivation but paid story access remains locked.

Files already downloaded to the User's own device are not affected by deletion from StoryStar.

  • access continues through the paid end date;
  • online stories are locked after that date;
  • the Account and stored family Content are retained for six calendar months; and
  • the Account and stored family Content are permanently deleted at the end of that period unless membership is reactivated.

14.7 Non-use

Failure to access the Platform, create stories, redeem Credits or use available features does not create an entitlement to a refund, credit or extension.

14.8 Outstanding amounts

Cancellation does not release you from valid charges incurred before cancellation.

15. FOUNDING FAMILY PROGRAMME

15.1 Eligibility

Founding Family status is:

  • invitation-only or subject to express approval;
  • attached to the approved Account;
  • personal to that Account; and
  • non-transferable.

15.2 Testing access

During a Founder testing period, a Founding Family may receive complimentary or enhanced access within limits set by StoryStar.

Testing access:

  • may be modified as the Platform develops;
  • may include unfinished or experimental features;
  • does not create an obligation to provide every testing feature permanently; and
  • may be withdrawn for misuse or breach.

15.3 Permanent discount

An approved Founding Family receives a permanent fifty percent discount on:

  • the then-current standard monthly subscription price; or
  • the then-current standard annual subscription price,

15.4 Meaning of permanent discount

The fifty percent discount applies to eligible future subscription renewals for so long as:

  • the Account maintains a qualifying subscription in good standing;
  • all payments remain current;
  • the Account remains controlled by the approved Founding Family; and
  • the User complies with these Terms.

15.5 Price changes

StoryStar may change its standard underlying plan prices. The Founder discount will continue to be calculated as fifty percent of the then-current standard price for the eligible plan.

15.6 Exclusions

Unless expressly stated otherwise, the Founder discount does not apply to:

  • Story Credit top-ups;
  • Download Credit purchases;
  • Printed Products;
  • shipping;
  • taxes;
  • third-party charges;
  • personalised add-ons; or
  • future products outside the eligible subscription.

15.7 No combination

The Founder discount may not be combined with another promotion unless StoryStar expressly permits it.

15.8 Loss of Founder discount

StoryStar may revoke the Founder discount in cases of:

  • fraud;
  • resale or attempted transfer;
  • serious or repeated abuse;
  • fraudulent chargebacks;
  • material breach of these Terms; or
  • manipulation of Founder eligibility.

15.9 Cancellation and reactivation

If a Founding Family cancels, StoryStar may allow the same approved Account to reactivate with the discount during any reactivation period displayed in the Account.

Unless StoryStar expressly confirms otherwise, cancellation for longer than the permitted reactivation period may result in loss of the Founder discount.

16. STORY CREDITS

16.1 Use

Story Credits may be redeemed for eligible custom story functionality displayed within the Platform.

16.2 No cash value

Story Credits:

  • are not legal currency;
  • have no cash value;
  • cannot be redeemed for cash; and
  • cannot be transferred or sold.

16.3 Expiry

Unless expressly stated otherwise when issued, Story Credits expire twelve months after the date on which they are credited to the Account.

16.4 Redemption order

Story Credits with the nearest expiry date may be redeemed first.

16.5 Subscription cancellation

Credits included with a subscription may remain available until the paid subscription term ends.

StoryStar may require an active subscription to redeem some or all Story Credits.

16.6 Purchased Credits

Purchased Story Credits remain subject to:

  • the twelve-month expiry period;
  • eligible feature availability;
  • Account status; and
  • these Terms.

16.7 Promotional Credits

Promotional or testing Credits may have different limits or expiry dates if clearly disclosed when they are issued.

16.8 Account deletion

All unused Story Credits are permanently forfeited when an Account is deleted.

17. DOWNLOAD CREDITS

17.1 Use

Download Credits may be redeemed for eligible downloadable content, including video or audiobook keepsakes and any other eligible format displayed within the Platform.

17.2 No expiry

Download Credits do not expire.

They remain associated with the Account until:

  • redeemed;
  • the Account is deleted;
  • they are removed following fraud or abuse; or
  • removal is required by law.

17.3 Account status

Although Download Credits do not expire, StoryStar may require an active subscription or active Account to redeem them.

17.4 No cash value

Download Credits:

  • have no cash value;
  • cannot be transferred;
  • cannot be sold; and
  • cannot be redeemed for cash.

17.5 Account deletion

Unused Download Credits are permanently forfeited upon Account deletion.

18. DIGITAL PRODUCTS AND PURCHASES

18.1 Digital Products

Digital Products may include:

  • Story Credits;
  • Download Credits;
  • custom stories;
  • custom Shared Adventures;
  • Memory Adventures;
  • digital storybooks;
  • videos;
  • audiobooks;
  • personalised Content; and
  • premium add-ons.

18.2 Delivery

A Digital Product is considered delivered when it is:

  • credited to the Account;
  • generated or processing has commenced;
  • made available within the Platform;
  • made available for download;
  • redeemed;
  • accessed; or
  • otherwise enabled for use.

18.3 Personalised Digital Products

Personalised and custom-generated Digital Products are created specifically for the User or family and may not be cancelled once generation or processing has commenced, except where required by law.

18.4 Technical failure

If a verified technical failure attributable to StoryStar prevents delivery or use, StoryStar may first:

  • restore the affected Credits;
  • regenerate the Content;
  • replace the Digital Product;
  • repair access; or
  • provide an equivalent remedy.

19. PRINTED STORYBOOKS AND THIRD-PARTY FULFILMENT

19.1 Printed Products

StoryStar may offer personalised Printed Products, including storybooks, yearbooks, keepsakes and gift editions.

19.2 Third-party providers

StoryStar may appoint third-party providers to:

  • print;
  • manufacture;
  • bind;
  • package;
  • ship; and
  • deliver Printed Products.

19.3 Information shared for fulfilment

To fulfil an order, StoryStar may provide the relevant fulfilment partner with information reasonably necessary for production and delivery, including:

  • recipient name;
  • delivery address;
  • contact details;
  • order specifications;
  • personalised text;
  • story Content;
  • relevant images; and
  • delivery instructions.

19.4 Customer responsibility

You are responsible for checking:

  • names and spelling;
  • Child Profile details;
  • photographs;
  • story selections;
  • delivery details; and
  • any available product proof,

19.5 Production commencement

Because Printed Products are personalised, an order may not be cancelled or changed after production begins.

19.6 Delivery estimates

Delivery dates are estimates unless expressly guaranteed.

StoryStar is not responsible for delays caused by:

  • delivery carriers;
  • customs;
  • incorrect delivery information;
  • import restrictions;
  • weather events;
  • force majeure; or
  • events outside StoryStar's reasonable control.

19.8 Quality notification window

A customer who believes a Printed Product is defective or materially below reasonable quality standards must notify StoryStar within two calendar days after delivery by emailing:

  • support@storystar.club

19.9 Required evidence

The notification should include:

  • order number;
  • delivery date;
  • description of the issue; and
  • clear photographs showing the alleged defect.

19.10 Qualifying defects

A qualifying defect may include:

  • missing pages;
  • unreadable printing;
  • materially damaged pages or cover;
  • incorrect binding;
  • incorrect personalised Content caused by StoryStar or its provider;
  • delivery of the wrong product; or
  • material production damage.

19.12 Replacement-first remedy

Where StoryStar confirms a qualifying defect, its first remedy will be a free replacement or reprint.

19.13 Refund following replacement failure

A refund may be provided where:

  • replacement is not reasonably possible;
  • StoryStar cannot provide a replacement within a reasonable period;
  • a replacement is also materially defective; or
  • applicable law requires a refund.

20. REFUND POLICY

20.1 General position

Except where required by law or expressly provided in these Terms, payments to StoryStar are non-refundable.

20.2 Monthly subscriptions

Monthly subscription fees are non-refundable once charged.

Cancellation prevents the next renewal but does not produce a refund for the current billing period.

20.3 Annual subscriptions

Annual subscription fees are non-refundable once charged.

Cancellation prevents the next annual renewal but does not result in a full or prorated refund for the current annual term.

20.4 Free-trial conversion

A charge resulting from a clearly disclosed automatic conversion at the end of a free trial is not refundable solely because the User forgot to cancel or did not use the Services.

20.5 Story Credits

Story Credit purchases are non-refundable once the Credits have been supplied to the Account, except where required by law or a material breach by StoryStar directly and substantially prevents their use.

20.6 Download Credits

Download Credit purchases are non-refundable once supplied to the Account, except where required by law or a material breach by StoryStar directly and substantially prevents their use.

20.7 Generated or personalised products

Custom stories, Shared Adventures, Memory Adventures, personalisations, narration products and other bespoke Digital Products are non-refundable once generation, personalisation, delivery, access or download has commenced.

20.8 Material breach by StoryStar

If you believe StoryStar has materially breached these Terms, you must notify:

  • legal@storystar.club

20.9 Opportunity to remedy

StoryStar will have up to thirty days after receiving sufficient notice to investigate and, where reasonably possible, remedy the alleged breach.

20.10 Remedy for uncured breach

If StoryStar confirms a material breach that cannot reasonably be remedied, or is not remedied within the applicable period, StoryStar may provide:

  • restored access;
  • replacement Content;
  • replacement Credits;
  • an extension;
  • account credit;
  • a prorated refund for the affected unused service period; or
  • another remedy required by law.

20.11 Discretionary goodwill

StoryStar may provide a discretionary refund, Credit or other goodwill remedy without admitting liability or creating an obligation to provide the same remedy in another case.

20.12 Refund abuse

StoryStar may refuse or investigate requests involving:

  • fraud;
  • repeated refund abuse;
  • consumption of the purchased product before requesting a refund;
  • unauthorised chargeback activity;
  • false information; or
  • manipulation of trial or promotional offers.

20.13 Mandatory consumer law

Nothing in this Section limits a mandatory consumer remedy that cannot lawfully be excluded.

21. DATA RETENTION FOLLOWING CANCELLATION

21.1 Cancellation retention period

Following expiry of a cancelled subscription or other authorised paid access period, StoryStar will retain the Account and associated family Content for six calendar months, measured from the paid access end date.

The purpose of this retention period is to support:

  • Account recovery;
  • reactivation;
  • customer support;
  • security;
  • fraud prevention; and
  • resolution of disputes.

21.2 Meaning of inactive Account

An Account is inactive for this policy when:

  • its paid subscription, free trial, Founder access or other authorised access has ended; and
  • the subscription has not been reactivated or replaced by another authorised paid access period.

21.3 Inactive Account deletion

StoryStar will permanently delete the Account and stored family Content six calendar months after the last authorised paid access period ends, unless the membership is reactivated before the scheduled deletion date.

Logging in during the retention period does not reset or postpone the deletion date.

  • Child Profiles and Family Member Profiles;
  • stored photographs and character references;
  • stories, illustrations, narration and reading history;
  • unused Story Credits and Download Credits; and
  • other User Content associated with the Account.

21.4 Annual subscribers

An annual Account will not be treated as inactive solely because more than six months have passed since the annual payment.

The Account remains active throughout its paid annual term.

21.5 Transaction records

StoryStar may retain invoices, payment records, tax records, fraud-prevention information and dispute records for longer where required by law or reasonably necessary for legitimate legal and accounting purposes.

22. ACCOUNT AND DATA DELETION

22.1 Cancellation is not deletion

Cancelling a subscription does not delete the Account immediately. Deletion is scheduled for six calendar months after paid access ends and is cancelled if the membership is reactivated before that date.

22.2 Deletion request

The Account Owner may request deletion through:

  • Account → Privacy & Data Settings → Delete Account

22.3 Verification

StoryStar may require reasonable identity or authority verification before deleting an Account, Child Profile, photograph or Family Narration.

22.4 Effect of deletion

Upon completion of an Account deletion request, or when the six-month post-cancellation retention period ends:

  • access will be removed;
  • Child Profiles will be deleted;
  • Family Member Profiles will be deleted;
  • stored photographs will be deleted;
  • Family Narrations will be deleted;
  • stories and reading history will be deleted;
  • unused Credits will be forfeited; and
  • the information may no longer be recoverable.

22.6 Child information

A parent or legal guardian may request deletion of a Child Profile under their control.

StoryStar may request verification of parental or guardian authority.

22.7 Narrator withdrawal

A narrator may request removal of their narration by contacting privacy@storystar.club.

Where justified and legally required, StoryStar will remove the narration from active use, subject to backup timing and retained consent records.

22.8 Backup retention

Personal Data removed from active systems may remain within encrypted backup and disaster-recovery systems for up to ninety days.

Backup data:

  • will remain protected;
  • will not be used for ordinary business purposes;
  • will be available only for restricted recovery, security or legal purposes; and
  • will be deleted or overwritten through StoryStar's normal backup-rotation cycle.

22.9 Backup restored

If a backup is restored, StoryStar will take reasonable steps to reapply applicable deletion requests.

22.10 Anonymised information

StoryStar may retain data that has been irreversibly anonymised so that it can no longer reasonably identify an individual.

22.11 No recovery obligation

Once information has been permanently deleted, StoryStar is not required to restore, recreate or recover it.

Users should preserve any permitted copies they wish to keep before requesting deletion.

23. ACCEPTABLE USE

You must not:

  • use StoryStar unlawfully;
  • submit content you do not have permission to use;
  • impersonate another person;
  • create misleading or fraudulent narration;
  • misuse photographs or child information;
  • threaten, harass or exploit another person;
  • attempt to gain unauthorised access;
  • circumvent plan restrictions or payment controls;
  • interfere with the Platform;
  • introduce malware or harmful code;
  • scrape or mass-download Content;
  • reverse engineer the Platform;
  • resell Digital Products or Credits;
  • share an Account outside the permitted family context;
  • use StoryStar for commercial content production without permission; or
  • infringe intellectual property, privacy or publicity rights.

24. SUSPENSION AND TERMINATION

24.1 StoryStar's rights

StoryStar may restrict, suspend or terminate access where:

  • these Terms are materially breached;
  • payment remains outstanding;
  • fraud or chargeback abuse is suspected;
  • User Content creates legal or safety risk;
  • Family Narration is misused;
  • the security or integrity of the Platform is threatened;
  • another person's rights may be infringed; or
  • action is required by law.

24.2 Notice

Where reasonably possible and lawful, StoryStar will provide notice and an opportunity to correct the issue before permanent termination.

Immediate action may be taken where necessary for child safety, security, fraud prevention or legal compliance.

24.3 Effect

Termination may result in:

  • loss of access;
  • removal of Content;
  • revocation of Credits obtained through fraud;
  • loss of Founder benefits where applicable; and
  • data retention or deletion under Sections 21 and 22.

24.4 Survival

Provisions concerning intellectual property, payments, refunds, liability, indemnity, dispute resolution, data retention and other provisions intended by their nature to survive will continue after termination.

25. THIRD-PARTY SERVICES

25.1 Service providers

StoryStar may rely on third parties for:

  • cloud hosting;
  • storage;
  • payment processing;
  • Merchant of Record services;
  • email and communications;
  • analytics;
  • artificial intelligence processing;
  • audio processing;
  • printing; and
  • delivery.

25.2 Provider terms

Some third-party features may be subject to terms or privacy notices presented by the relevant provider.

25.3 Replacement of providers

StoryStar may replace a third-party provider or integration where reasonably necessary.

25.4 Third-party availability

StoryStar does not guarantee the uninterrupted availability of a third-party service.

StoryStar will use reasonable efforts to maintain or restore affected StoryStar functionality.

26. SERVICE WARRANTIES AND DISCLAIMERS

26.1 Service basis

To the maximum extent permitted by law, StoryStar is provided on an "as is" and "as available" basis.

26.2 No absolute warranty

StoryStar does not warrant that:

  • the Platform will always be uninterrupted;
  • all defects will be corrected immediately;
  • every device or browser will be supported;
  • generated Content will always be accurate;
  • every story will meet individual preferences; or
  • a particular third-party feature will remain available.

26.3 Non-excludable warranties

Nothing in these Terms excludes a warranty or obligation that cannot legally be excluded.

27. LIMITATION OF LIABILITY

27.1 Non-excludable liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

27.2 Excluded losses

To the maximum extent permitted by law, StoryStar and its directors, employees, contractors, affiliates, licensors and suppliers will not be liable for:

  • indirect loss;
  • consequential loss;
  • loss of profit;
  • loss of business opportunity;
  • loss of goodwill;
  • loss arising from unauthorised Account access not caused by StoryStar;
  • loss caused by inaccurate User Content;
  • AI-generated inaccuracies;
  • interruption caused by events outside reasonable control; or
  • misuse of StoryStar by a User.

27.3 Data and memories

StoryStar will apply reasonable safeguards but cannot guarantee that Content will never be corrupted or lost.

Users should maintain permitted copies of especially important downloadable keepsakes.

27.4 Printed Products

Subject to mandatory law, StoryStar's liability concerning a defective Printed Product will ordinarily be limited to:

  • replacement;
  • reprint;
  • refund of the amount paid for the affected product; or
  • another legally required remedy.

27.5 Liability cap

To the maximum extent permitted by law, StoryStar's total aggregate liability arising out of or connected with the Services will not exceed the greater of:

  • USD 100; or
  • the total amount paid by the User to StoryStar during the twelve months immediately preceding the event giving rise to the claim.

27.6 Application of limitation

The limitations in this Section apply regardless of the legal basis of the claim, to the extent permitted by applicable law.

28. USER INDEMNITY

28.1 Indemnity

To the extent permitted by law, you agree to indemnify StoryStar against third-party claims, losses, liabilities and reasonable costs arising from:

  • User Content submitted without permission;
  • unauthorised use of a person's image or voice;
  • unlawful or fraudulent use of StoryStar;
  • infringement of third-party rights;
  • material breach of these Terms; or
  • deliberate misuse of the Platform.

28.2 Consumer limitation

This indemnity will not apply to the extent that a claim results from StoryStar's own breach, negligence or unlawful conduct, or where applying the indemnity would violate mandatory consumer law.

29. CHARGEBACKS AND PAYMENT DISPUTES

29.1 Contact StoryStar first

Users are encouraged to contact support@storystar.club before initiating a chargeback so StoryStar can attempt to resolve the issue.

29.2 Investigation

StoryStar and its payment provider may investigate:

  • chargebacks;
  • unauthorised payment reports;
  • fraud claims; and
  • payment disputes.

29.3 Temporary restrictions

During an investigation, StoryStar may temporarily restrict:

  • subscription access;
  • Digital Products;
  • Credit use; or
  • further purchases.

29.4 Evidence

StoryStar may provide relevant transaction, Account and service-delivery evidence to the payment provider or financial institution.

29.5 Fraudulent disputes

Fraudulent or abusive chargebacks may result in Account suspension, revocation of improperly retained benefits and recovery of amounts lawfully due.

30. DISPUTE RESOLUTION

30.1 Good-faith resolution

Before commencing court proceedings, the parties will attempt in good faith to resolve the dispute.

30.2 Notice of dispute

A dispute notice must be sent to:

  • legal@storystar.club

30.3 Notice content

The notice should include:

  • the User's name and Account email;
  • a description of the dispute;
  • relevant dates and transactions;
  • supporting information; and
  • the proposed resolution.

30.4 Response period

The parties will attempt to resolve the dispute for thirty days after StoryStar receives sufficient written notice.

30.5 Urgent remedies

The thirty-day period does not prevent either party from seeking urgent interim, protective or injunctive relief where reasonably necessary.

30.6 Consumer complaints

Nothing in this Section prevents a consumer from contacting a competent consumer-protection or regulatory authority.

31. GOVERNING LAW

These Terms and any non-contractual obligation arising from or connected with them are governed by:

  • the laws of the Emirate of Dubai; and
  • the applicable federal laws of the United Arab Emirates.

32. JURISDICTION

Subject to mandatory law, the Courts of Dubai, United Arab Emirates will have exclusive jurisdiction over any dispute, controversy, proceeding or claim arising out of or connected with:

  • these Terms;
  • the Platform;
  • the Services;
  • subscriptions;
  • Digital Products;
  • Printed Products;
  • Child Profiles;
  • Family Narration; or
  • the relationship between StoryStar and a User.

33. FORCE MAJEURE

StoryStar will not be liable for delay or failure caused by circumstances outside its reasonable control, including:

  • natural disaster;
  • war or civil disturbance;
  • government action;
  • epidemic or pandemic;
  • communication or internet failure;
  • cloud or infrastructure outage;
  • labour disruption;
  • shipping disruption;
  • customs delay; or
  • failure of an essential third-party provider.

34. CHANGES TO THESE TERMS

34.1 Updates

StoryStar may update these Terms to reflect:

  • changes to the Services;
  • legal or regulatory developments;
  • security requirements;
  • new products;
  • changes to third-party providers; or
  • commercial changes.

34.2 Notice of material changes

Where reasonably required, StoryStar will notify Users of material changes through:

  • the Platform;
  • Account notification;
  • email; or
  • another appropriate channel.

34.3 Acceptance of updated Terms

Continued use after updated Terms take effect constitutes acceptance, except where further affirmative consent is required by law.

A User who does not accept a material change may stop using StoryStar and cancel before the next renewal.

35. ELECTRONIC COMMUNICATIONS

35.1 Electronic delivery

You agree that StoryStar may provide contractual notices, receipts, confirmations, disclosures and Account communications electronically.

35.2 Contact information

You must maintain a valid Account email address.

36. GENERAL PROVISIONS

36.1 Entire agreement

These Terms, the Privacy Policy, applicable checkout disclosures and any product-specific conditions form the entire agreement concerning the Services.

36.2 Severability

If a provision is found invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable.

36.3 No waiver

A failure or delay in exercising a right does not waive that right.

36.4 Assignment

You may not transfer or assign your Account or rights under these Terms without StoryStar's written approval.

StoryStar may transfer these Terms as part of a corporate restructuring, financing, merger, acquisition or sale of all or substantially all of the relevant business, subject to applicable law and privacy requirements.

36.5 Relationship

These Terms do not create a partnership, employment, agency, fiduciary or joint-venture relationship.

36.6 No third-party beneficiaries

Except where expressly stated, these Terms do not grant contractual rights to a person who is not a party to them.

36.7 Headings

Headings are for convenience and do not affect interpretation.

36.8 Language

These Terms may be made available in multiple languages.

If translated, the controlling version will be the version identified by StoryStar, subject to applicable law and any requirement that an Arabic version prevail or be provided.
